What happens when apt management is given info about one of their tennants growing pot plants in their unit?

Would they call the police or handle it themselves? USA
And does such behavior of tennants make apartment management legally liable/responsible for anything?

Hopefully they would call that cops on them….that way they can be given a 3 day eviction notice.
Yes, if management is aware of the situation and fails to act accordingly, they CAN be held liable should something go wrong.

Growing pot in your apartment is illegal. this is against your lease, and you can be evicted for it. I have worked at property’s where the manager just sent them a letter and said stop doing it, all the way to one that she called the cops and had me take them into the unit. A lot of it depends on the severity of the laws in your area.

  • Trouble:

    It depends.

If the police get involved, the rental can be held up and the landlord unable to rent it. Also, if the growing operation is for money and the rent was paid with drug money, the landlord could face some serious problems.

I actually had this happen to me. I called my attorney first. His advice was to take pictures and keep the police out of it initially. I gave the tenant notice to cure the illegal activity within 24 hours – have all growing equipment and all illegal plants removed from the property or the police would be called.

The tenant removed everything. We inspected every nook and cranny. The tenant was then given notice to terminate their tenancy and move out or be evicted through the courts. Of course, in the eviction, our evidence of his illegal activity would come out – not good for him at all. He moved out without us having to take him to court.

The point is to get the illegal drugs out of the rental immediately. The landlord is safe until they have actual knowledge of illegal drugs. Once the landlord has knowledge of the illegal drugs, they should do whatever it takes to make it known that they do not condone such activity and get the drugs out of their property.
