What general insurance covers management for costs should it be sued by or wishes to sue a third party?
Further clarification: Can this General Liability Insurance be applied when the insured is SUEING ie the insured is the PLAINTIFF? I have always understood that this type of insurance only covers costs if the insured is the defendant or is BEING SUED.
general liability coverage, sometimes called commercial general liability.
The type of insurance that covers legal expenses when acting as the plaintiff is usually known as ‘after the event’ or ‘ATE’ legal expenses cover.
ATE Insurance is a type of legal expenses insurance policy that provides cover for the costs incurred in the pursuit or defence of litigation. The policy is purchased after the cause of a legal dispute has arisen, which is why it is called as “After the Event” insurance. It is also known as ATE insurance, Litigation Insurance, Conditional Fee Insurance, Post-Event Insurance, AEI or LEI Insurance.
ATE insurance can be purchased for nearly all areas of litigation and is frequently used in both civil and commercial disputes. Insurance can be purchased for cases requiring modest limits of indemnity, through to big ticket, heavyweight litigation.
Payment of the ATE premium is generally deferred until the conclusion of the case and contingent upon success. In addition to which, (in the UK at least), ATE premiums can be recovered from the other side under the “loser pays” costs principle. ATE insurance is therefore equally relevant to private individuals, impecunious or insolvent clients, SMEs or large blue chip companies
I’m afraid I’ve no idea if this type of insurance is available where you are, especially if you are in the US where the insurance industry is rather less advanced than some other parts of the world.
The link below shows some example cases, costs etc that you may find interesting. I am not in any way recomending the company itself (though I’m sure they are wonderful people) as I have had no dealings with them.
Cheers
